WikiTeq Hosted Wiki — Legal Information

These Terms of Service, Privacy Policy, and Cookie Policy apply to your use of wikis hosted on the WikiTeq Qloud platform. Each wiki is operated by its owner (the Client). WikiTeq provides hosting and related technical services. For wiki account, content, or community matters, contact the Client or wiki administrator first. Terms of Service

1.1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of wikis hosted on the WikiTeq Qloud platform (collectively, the "Service"). By accessing, browsing, or using any wiki hosted through the Service, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Service.

Your use of the Service, including by clicking an "I agree" button or similar control where presented, constitutes your electronic acceptance of these Terms.

The Service is provided by WikiTeq, Inc. ("WikiTeq," "we," "us," or "our"), located at 1700 N Dixie Hwy, Suite 157, Boca Raton, FL 33432.

Each wiki is owned and administered by the organization or individual that operates it (the "Client"). WikiTeq provides hosting and related technical services to the Client. These Terms apply to you as an end user of any Qloud-hosted wiki worldwide.

1.2 Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

The Service is not directed to children under 13, and we do not knowingly permit such children to use the Service. See Section 2.9 (Children's Privacy).

1.3 Accounts and Access

Some wikis allow or require you to create a registered account. When you register:

• You must provide accurate and complete information and keep it up to date.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must notify the wiki administrator or Client promptly if you believe your account has been compromised.
• WikiTeq and the Client may suspend or terminate accounts that violate these Terms or applicable law.

WikiTeq does not guarantee uninterrupted access to any wiki. Maintenance, security measures, or circumstances beyond our reasonable control may affect availability.

1.4 Acceptable Use

You agree to use the Service lawfully and in a manner consistent with these Terms. You must not:

• Upload, post, transmit, or otherwise make available content that is illegal, fraudulent, defamatory, harassing, threatening, obscene, or otherwise objectionable under applicable law.
• Distribute malware, viruses, or other harmful code, or attempt to gain unauthorized access to any system, account, or data.
• Exploit, harm, or attempt to exploit or harm minors in any way, including content that depicts or promotes child sexual abuse or exploitation.
• Interfere with or disrupt the Service, its infrastructure, or other users' access.
• Scrape, crawl, or harvest data from the Service in violation of the wiki's policies or applicable law, except as permitted by the Client or by law.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service for spam, phishing, or unsolicited commercial messaging in violation of applicable law.

WikiTeq and the Client may remove content or restrict access that violates this section or that we reasonably believe poses a risk to users, the Client, or the Service.

1.5 Content and Licenses

Your content. You retain ownership of content you submit to a wiki, subject to any license terms the Client has established for that wiki. WikiTeq does not set a default content license for wiki contributions; licensing of user-generated content is determined by the Client and disclosed on the wiki where applicable.

License to WikiTeq. By submitting content to a wiki hosted on the Service, you grant WikiTeq a limited, non-exclusive, royalty-free, worldwide license to host, store, cache, back up, transmit, and display that content solely for the purpose of providing hosting and related technical services to the Client. This license ends when the content is deleted from the Service in accordance with our retention practices, except as required for backups or legal compliance.

No endorsement. WikiTeq does not endorse, verify, or assume responsibility for user-generated content on any wiki.

1.6 Client Responsibility

The Client is responsible for the wiki's configuration, policies, moderation, and the conduct of its users. The Client is the primary point of contact for matters relating to wiki accounts, contributions, and content-specific requests.

To the fullest extent permitted by law, the Client is liable for content posted by its users and for ensuring that the wiki's use of the Service complies with applicable law. WikiTeq's role is limited to providing hosting and platform services to the Client.

1.7 Intellectual Property

The Service, including the WikiTeq and Qloud names, logos, software, and underlying technology, is owned by WikiTeq or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no license or right is granted to you in WikiTeq's intellectual property.

If you believe content on a wiki infringes your copyright or other intellectual property rights, see Section 1.12 (Copyright and DMCA).

1.8 Termination and Suspension

WikiTeq or the Client may suspend or terminate your access to a wiki, or remove content, at any time for violation of these Terms, legal requirements, or to protect the Service or other users. Upon termination of a wiki by the Client, your account and associated content on that wiki will be handled in accordance with the Client's policies and our data retention practices.

1.9 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WIKITEQ DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WIKITEQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT ON ANY WIKI IS ACCURATE, COMPLETE, OR RELIABLE.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.

1.10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WIKITEQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WIKITEQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WIKITEQ'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID DIRECTLY TO WIKITEQ FOR ACCESS TO THE SPECIFIC WIKI GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (IF ANY).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or willful misconduct where such limitation or exclusion is not permitted.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

1.11 Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless WikiTeq and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) content you submit, or (c) your violation of these Terms or applicable law.

1.12 Copyright and DMCA

WikiTeq respects intellectual property rights and expects users to do the same. If you believe that material on a wiki hosted through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act ("DMCA") to WikiTeq's designated agent:

Your notice must include the information required by 17 U.S.C. § 512(c)(3), including:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit WikiTeq to locate the material on the wiki.
4. Information reasonably sufficient to permit WikiTeq to contact you, such as an address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, WikiTeq may remove or disable access to the material identified in the notice and may notify the user who posted it. WikiTeq may terminate, in appropriate circumstances and at our discretion, the accounts of users who are repeat infringers.

If you believe material was removed or disabled in error, you may submit a counter-notification to the designated agent above that includes the information required by 17 U.S.C. § 512(g)(3). WikiTeq may restore the material in accordance with the DMCA if a valid counter-notification is received and the claimant does not file a court action within the time permitted by law.

1.13 Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles that would require application of the laws of another jurisdiction. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts.

1.14 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

1.15 Electronic Communications

By using the Service, you consent to receive communications from WikiTeq and the Client electronically, including notices posted on a wiki or sent to the email address associated with your account. You agree that such electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

1.16 Assignment

You may not assign or transfer these Terms or any rights or obligations under them without WikiTeq's prior written consent. WikiTeq may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, or to an affiliate, without your consent.

1.17 Waiver and Severability

WikiTeq's failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

1.18 Entire Agreement; Survival

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and WikiTeq regarding the Service and supersede any prior or contemporaneous understandings on that subject.

Sections that by their nature should survive termination or expiration of these Terms will survive, including Sections 1.5 (Content and Licenses, to the extent necessary for backups and legal compliance), 1.9 (Disclaimers), 1.10 (Limitation of Liability), 1.11 (Indemnification), 1.12 (Copyright and DMCA), 1.13 (Governing Law and Disputes), 1.17 (Waiver and Severability), and this Section 1.18.

Privacy Policy

2.1 Scope and Roles

This Privacy Policy describes how WikiTeq, Inc. ("WikiTeq," "we," "us," or "our") processes personal information in connection with wikis hosted on the WikiTeq Qloud platform (the "Service"). It applies to visitors, readers, and registered users of any Qloud-hosted wiki worldwide.

Roles:

• The Client (the wiki owner or operator) is generally the data controller (or "business," where that term applies under U.S. state privacy laws) for personal information collected and used in connection with the wiki's content, accounts, community policies, and user-facing features the Client configures.
• WikiTeq acts as a service provider to the Client and, where applicable, a data processor processing personal information on the Client's documented instructions to provide hosting, security, and related technical services.
• For certain limited hosting and platform operations—such as server and security logs, abuse prevention, DMCA compliance, and communications about the Service—WikiTeq may act as an independent controller (or business) with respect to the specific information necessary for those purposes. WikiTeq is not the sole controller for all personal information processed through a wiki.

This Policy explains WikiTeq's practices as a hosting provider. For requests relating to your wiki account, edits, or content-specific data practices, contact the Client or wiki administrator first. For hosting- and platform-related inquiries within WikiTeq's role, contact WikiTeq as described in Section 2.12.

2.2 Information We Collect

The information collected depends on how you interact with a wiki and how the Client has configured it. Typical categories include:

Information you provide

• Account information: username, display name, email address, password (stored in hashed form), and other registration fields the Client enables.
• User contributions: edits, talk page messages, uploads, and other content you submit to the wiki.
• Communications: messages you send to wiki administrators, support channels, or WikiTeq where applicable.

Information collected automatically

• Usage and log data: IP address, browser type and version, device information, referring URL, pages viewed, timestamps, and similar technical data generated when you access the Service.
• Cookies and similar technologies: as described in our Cookie Policy.
• Security data: signals used to detect abuse, fraud, and unauthorized access.

Information from third parties

• The Client or integrated tools the Client enables (for example, authentication or anti-abuse services) may provide limited information necessary to operate the wiki.

WikiTeq does not require you to provide sensitive categories of personal information to use the Service unless the Client configures fields that request such information.

2.3 How We Use Information and Legal Bases

WikiTeq uses personal information to:

• Provide, operate, maintain, and improve the hosting Service for the Client.
• Authenticate users and manage wiki accounts as configured by the Client.
• Store, display, back up, and transmit wiki content and related metadata.
• Monitor, prevent, and address security incidents, abuse, and technical issues.
• Comply with legal obligations and respond to lawful requests.
• Communicate with the Client and, where appropriate, users about hosting-related matters.

We do not use personal information for unrelated marketing purposes on behalf of third parties. We do not sell personal information.

Legal bases (where GDPR, UK GDPR, or similar laws apply). When WikiTeq processes personal information on the Client's behalf, the Client determines the legal bases for that processing. When WikiTeq processes personal information as an independent controller for hosting and platform operations, we rely on:

• Performance of a contract or steps taken at your request before entering a contract, where processing is necessary to provide the Service.
• Legitimate interests, such as securing and operating the platform, preventing abuse, and protecting users, balanced against your rights and interests.
• Legal obligation, where processing is required by applicable law.
• Consent, where required by law and obtained through appropriate means (for example, for certain non-essential cookies as described in our Cookie Policy).

2.4 How We Share Information

WikiTeq shares personal information only as described below:

• With the Client: WikiTeq provides the Client and authorized wiki administrators access to account and usage information needed to operate the wiki.
• With service providers: We use trusted third parties that assist in providing the Service, subject to contractual protections. See Section 2.5.
• For legal and safety reasons: We may disclose information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect rights, safety, and security, or to investigate fraud or abuse.
• Business transfers: If WikiTeq is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to appropriate safeguards.

Public wikis may display information you choose to publish (for example, your username and edit history) to other visitors in accordance with the wiki's configuration.

2.5 Subprocessors and Infrastructure

WikiTeq uses cloud infrastructure providers and other technical vendors to host and deliver the Service. These providers process personal information on WikiTeq's instructions and are bound by contractual obligations appropriate to their role.

We do not list individual vendor names in this Policy; vendors may change as we improve the Service. WikiTeq remains responsible for the processing it directs on the Client's behalf, subject to applicable law.

2.6 International Data Processing

WikiTeq is based in the United States. Personal information processed in connection with the Service is handled in the United States and is not intentionally transferred to other countries for processing, except where necessary to deliver the Service through our infrastructure providers or as required by law.

If you access the Service from outside the United States—including from the European Economic Area, the United Kingdom, or Switzerland—you understand that your information will be processed in the United States, which may have data protection laws that differ from those in your jurisdiction. Where required by applicable law, the Client (as controller) is responsible for establishing an appropriate transfer mechanism for personal information the Client collects; WikiTeq supports the Client's compliance obligations through applicable service terms.

2.7 Data Retention

Retention periods depend on the type of data and the Client's relationship with WikiTeq:

The Client may configure additional retention or deletion practices for wiki content; consult the wiki's own policies where published.

2.8 Security

WikiTeq implements administrative, technical, and organizational measures designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If you become aware of a security issue affecting a wiki, notify the Client and, for hosting-related concerns, contact WikiTeq at [email protected].

2.9 Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in a manner that would require parental consent under the U.S. Children's Online Privacy Protection Act ("COPPA") or similar laws. If you believe a child under 13 has provided personal information through a wiki, contact the Client or wiki administrator so appropriate action can be taken. You may also notify WikiTeq at [email protected].

2.10 Your Privacy Rights and Requests

Depending on where you live, you may have rights regarding your personal information, such as access, correction, deletion, restriction, objection, or portability. The availability of these rights depends on applicable law and the role WikiTeq plays with respect to the information at issue.

Wiki account and content requests. Contact the Client or wiki administrator. The Client controls account data, editorial history, and wiki-specific policies and is best positioned to respond to requests about your contributions and profile.

Hosting and platform requests. For inquiries about WikiTeq's processing as a hosting provider (for example, questions about server logs, security incidents, or this Privacy Policy), contact us at [email protected]. We will respond within a reasonable time and, for formal rights requests where applicable, typically within thirty (30) days, unless a longer period is permitted by law.

We may need to verify your identity and coordinate with the Client before fulfilling certain requests. We may decline requests that are unfounded, excessive, repetitive, or prohibited by law.

Residents of the EEA, UK, and Switzerland. Where GDPR, UK GDPR, or similar laws apply and WikiTeq is a controller of the relevant information, you may have the right to lodge a complaint with your local data protection supervisory authority. We encourage you to contact us first so we can try to resolve your concern.

U.S. state privacy laws. Residents of certain U.S. states may have additional rights regarding personal information. WikiTeq does not sell personal information. Where WikiTeq acts as a service provider to the Client, requests about wiki account and content data should be directed to the Client.

2.11 Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last updated" date. We encourage you to review this Policy periodically.

Cookie Policy

3.1 What Are Cookies

Cookies are small text files placed on your device when you visit a website. Similar technologies (such as local storage, pixels, and session identifiers) may be used for comparable purposes. This Cookie Policy explains how cookies and similar technologies may be used on wikis hosted through the WikiTeq Qloud platform.

3.2 Types of Cookies We May Use

WikiTeq and/or the Client may enable cookies and similar technologies in the following categories:

The specific cookies in use on a given wiki depend on how the Client has configured the wiki and which optional features are enabled.

3.3 Essential vs. Non-Essential Cookies

Essential cookies are necessary for the Service to function and cannot be switched off in our systems without impairing core functionality. They are typically set in response to actions you take, such as logging in or submitting a form, or to deliver security and load-balancing functions.

Non-essential cookies (such as analytics and certain preference cookies) are not strictly required for the wiki to operate. Where required by applicable law, non-essential cookies will be used only after you have been given appropriate notice and, where necessary, have provided consent through an available consent mechanism.

3.4 Consent and Notice

Where a wiki uses non-essential cookies, you may be notified through:

• A cookie notice or banner (for example, the CookieWarning extension), which provides information about cookie use and, where configured, controls through which you may accept or decline non-essential cookies; and/or
• This Cookie Policy and the Privacy Policy.

CookieWarning and similar tools are notice and preference mechanisms. They are not, by themselves, a guarantee of compliance with every jurisdiction's consent requirements. Where legally required, consent for non-essential cookies must be obtained before those cookies are placed, using the notice, controls, or other means made available on the wiki.

Third-party services. Where a third-party CAPTCHA, analytics, or similar service is enabled, use of that service may be subject to the provider's terms and privacy policy in addition to this Policy. Such services may collect device and usage information and transmit it to the provider for analysis.

3.5 Managing Cookies

You can control cookies through:

• Cookie notice settings on the wiki, where a notice or consent tool is presented.
• Browser settings to block, delete, or alert you about cookies. Note that blocking essential cookies may prevent you from using certain features, including logging in.
• Opt-out tools provided by analytics or advertising vendors, where applicable and where the Client has enabled such services.
